Anyone know about sick pay

    I am hoping someone can advise me I have been ill for a few weeks which could last a few months I go to work at 4.30 every morning but as I cant drive at the moment my OH is having to get up and come with me my employer says I am not entitled to sick pay and if I am off sick he will have to get someone else to do the job this is a cleaning job 18hrs a week I have never been given a contract and have done the job for 12yrs cant afford to lose it the hospital have said no work for at least 4 months anyone know if he can just sack me:scared:

    Contact the CAB. If you have no contract, im not sure where you stand.

    You may still be able to claim SSP, and you will need a certificate from your doc to do so (you can self certify for the first 10 days i think it is).

    I'll stand corrected if i'm wrong,but i'm 99.9% sure they can't sack you because of an illness.As for having a contract it doesn't have to be in writing.

    They can by law.

    I was.

    I sought legal advice and was told they were well within their rights to do so.

    Whilst a verbal contract is a valid one it becomes very tricky indeed, as at the end of the day it is your word against his.

    Whilst I do not want to suggest any illegal practices is this job paid cash in hand or are you getting pay slips and are you sure that tax and National Insurance is being credited to you? If you are being credited then that proves you are being employed by him.

    Yes he can sack you for illness although it is a long and drawn out procedure, he doesn't have to pay you company sick pay, you would just be entitled to statutory sick pay! But you do not have to be in employment to receive this!

    After 12 years they better have a bl**dy good reason to sack you.
    You cannot be sacked for being ill but you can be sacked for other reasons while sick

    You are dismissed because of your disability

    If you are disabled and your employer dismisses you for taking time off sick for a reason connected with your disability, your employer could be breaking the law. You may be able to make a complaint to an employment tribunal for disability discrimination.

    You may have to raise a written grievance first.

    Have alook at this site. It's the Direct Gov site and gives info about Statutory Sick Pay.

    Sorry about the repeat. Had this window open and left to have my morning break. Hit post just now not realising the previous replies.

    Blinking hell. Dont you just hate them !!

    Although it has been said they can......there must be something that protects you, else all workers that are off on sick would be sacked willy nilly.

    Yes get a pay slip each month with all the stopages,does"nt sound to hopeful to me guess I"ll just have to keep my mouth shut and get OH to keep coming with me it is a key job so he wont know OH is doing the work what annoys me is never been off sick in the 12 yrs I"ve worked for him:mad:
