Urinary Infection. Should I sue the breeder?
Hi everyone! I know my title seems sort of awkward but I am at my whits end. Bella is 4 months old, we got her when she was just 8 weeks old. The breeder we got her from owned a farm, poor Bella was infested with fleas, had worms horribly and when we took her to get wormed she had a urinary infection. Since then she has had 2 others and today, she is straining and I noticed a bloody discharge, almost like she's in her first heat. But she's 4 months old! Now to get to my question, should I think about suing the breeder we got her from? She sold her to us for 480 pounds and has one puppy left that she is selling for 100 pounds. Is it worth my time?

I doubt you would get anywhere with it. If, as you say, she was infested with fleas and worms then really you should have walked away and not taken her. Its hard, but avoids this sort of situation where the breeder can say you took her and didnt return her so there cant have been an issue (in their opinion).
What you "should" have done was return the pup to the breeder when the vet said there was something wrong. Then if she refused to give your money back you could have sued for it, but as you have had the dog 2 months the breeder could argue that the problems have only happened since the pup has been with you. I would be rather concerned that your vet has been unable to clear up a simple uti in 2 months though. It shouldnt take more than a week or two to clear up with ABs.

She is a Labrador. Well actually, a spotted Labrador. That's why we paid so much for her, because she is different. I'll put her picture as my profile one. It's not that she has had a uti for the past 2 months, she gets them, it clears up then after a few weeks its back. I asked the vet if maybe she has kidney or bladder stones and they are checking the sediment in her urine this time to be sure. I hate to see my puppy in pain and it's hard on my husband and I too. Plus, it's knocked the house training back with her not being able to let us know she has to go out. We knew the puppies (our dog and her 5 siblings and the mother) were living in a barn but the breeder told us she had been wormed and given a flea dip. She even showed us the dewormer she uses on all of her dogs (she must have a dozen of them running around on her farm). So we didn't think anything of it, the puppies didn't seem to have fleas when we went to look at them and neither did the mother. So I appreciate the advice but we aren't completely unthoughtful about our puppy. Now, if for some reason we would get a report back from the vet that this could be a hereditary thing, her uti or bladder infection, would we have a case then? Because yes you buy a puppy "as is" for lack of better words but you don't intend to buy a puppy with a hereditary condition. I'm just getting advice now in case it would come to that =\

Theres no such thing as a spotted labrador, so the breeder should be done for false advertising.
Its very unlikely that you would get anywhere in court. Its only usually health problems that can be prevented by DNA testing breeding stock, where you would have some sort of legal standing. Sounds like you have just been extremely unlucky. Might be worth looking at her diet. |

I doubt that the puppyfarmer will have any sort of insurance so you'll be fighting them personally which will leave you the one paying out for legal advise etc. I'd chalk it down to experience and a lesson learnt I'm afraid.
Just aside is there such a thing as a 'spotted' lab? Thought it meant the dogs weren't pure bred if they weren't fully coloured? Edited to add...just seen her piccy!! Gosh she's lovely! Doesn't look hugely lab like but stunning dog no the less. Last edited by JSR; 18-02-2010 at 03:42 PM.. |

Agree there is no such thing as a spotted Lab.
What does your contract say? Most would say that the new owner should have the puppy checked by a vet within x number of days and to contact the breeder with any problems. Without a contract there probably isn't anything you can do. Is the puppy KC registered? |

Is she the merle dog in your avatar?
If so, she is not a labrador so i certainly hope you didnt pay much for her. Looks like a collie x lab, or possible some great dane cros from the head - either way, you could get one from the local rescue centre, and probably with less health problems!! Seems like you have been duped. I imagine it was a puppy farmer so you will have no luck getting any money back, i guess you will just have to learn from this mistake and research your breeder better next time.
