The bitch owner can't register any pups because she has endorsements/restrictions.

Re: problems with stud fee

On the regsitration form there a couple of boxes you tick, the registered owner of the dog i.e the breeder can apply to have any of the following placed on the records of the dog, progency not eligble for registration and not eligible for the issue of an export pedigree, the codes need to be included next to the puppy if the breeder wishes to place endorsements.

The OP has said the bitch has endorsements on her KC certificate therefore,if any pups are produced they can't be registered. She should have asked the breeder to lift the endorsement and the stud owner the OP,should have made sure the bitch was not endorsed before agreeing to the mating.

I would if I had their details.. but if I ask her for the breeders details now.. she'd probably get suspicious and refuse to give them to me.

Re: problems with stud fee

Ask to see the pedigree or KC papers,so you can see the endorsement, make a note of the breeders address or number.

Re: problems with stud fee

ok.. an update... fee has now eventually been received in full ( it took 6 weeks!)
and in the mean time, she has now been told that the bitch isn't pregnant.
The lass asked me if i'd do her a receipt for a free mating ( which I have no problems with... but i'm still not sure if her dog has had it's restrictions lifted.. should this make a difference?)
Also, she's said that if her bitch doesn't take from the 2nd mating ( the free one) that she wants her money back !!!!!!!mad: I think not.. and told her that the fee is non returnable and that the 2nd mating is free anyway!
She's basically threatened me ( by text message). and said if her dog doesn't produce pups next time, she will demand her money back.. she also says she's been in contact with a solicitor ( bearing in mind that these are text messages that have been sent/received within a matter of a couple of hours)..she reckons this solicitor has said that she is entitled to a full refund of her money!!
she then goes on to say that her parents have been breeding dogs for 32 years and they also say that I'm being out of order!!!
So i'm going to be hearing from her solicitor if I don't refund her money !

If her parents where that good a breeders to start with, surely they would have advised their daughter NOT to mate a dog with restrictions???
BTW.. have also found out that she is not listed as the legal owner of the dog ( she aquired it some time ago and hasn't bothered to change ownership details !)

what should I do ?? is there anything she can do?? or does she not have a leg to stand on??

Re: problems with stud fee

Basically she hasn't got a leg to stand on.

A case like this recently went to court, whereby it was decided the owner of the bitch paid for the service of the stud dog,not him producing pups.

Let her waste her money in the form of solicitors etc.....

Get a contract drawn up ASAP,stating she has paid for the service of your dog not pups produced, also check the endorsement on the bitches KC Registration has been lifted, you can refuse the mating if it hasn't and have got good grounds for doing so.
