I have to say .... obviously your dog isnt a proven dog, is it the bitches first time? as tbh the bitch should have had a proven male if it was. Also payment at the time of studding should have been given and in return a receipt and promise of a free mating next time if bitch doesnt take from you. Always best to get bitch owner to bring any documents with her vaccinations cards too. And a good idea is to check any health test certificates too
Also don't part with any pedigree info of your dog till you see those pups or have vet confirmation on what shes had.
I have a stud but he only studs out to one other person i use him for my own toys and any bitches have to be health tested

oh i forgot to add...obviously the owner of the bitch has no regard for anyone hun as shes blatently breeding a dog with restrictions common decency would be for her to contact the breeder and ask if it was possible to be lifted . If shes no respect for breeder of her dog she will have none for you and ur stud fee

i'm only sorry I never found this site til after the mating so as to post on here to gain the insight of more experienced breeders to start with

I will certainly be looking into drawing up a contract for the next time... but before I do so.. I will be asking some questions on here first

There is only one person I trust and that's myself. I would request any monies no later than the day of mating. After all we have to pay for what ever service no later than the completion date.

I think warning bells would have rung if she couldn't afford a stud fee how could she afford vet fees if necessary - okay there is pet insurance but I think you know where I am coming from.

You could pursue a claim but you could end up paying legal fees and being well out of pocket given it was a verbal agreement.

I hope everything turns out right for you, in that you get paid in full and there will soon be a litter of pups.

Good post Sue,
I wll just pick up on a point you made about pet Insurance,very few companies will not cover any claim made whilst the bitch is in whelp if it is a result of that,or if they need a c-section which can be very expensive especially out of hours.A friend of ours had to have his bitch sectioned out of hours had 2 dead pups,2 live ones and had a bill for nearly £900,so definatly not cheap.The sale of the pups never even covered the vet bill,plus all the extra bedding,food,laundry etc....

You could consider sending her a letter threatining court action... might get her to concentrate.

Given the nature of the agreement (your word against hers) I probably wouldn't go as far as court, although you don't have an overly bad case, there's no proof if she lies.

If she tells the truth:

Judge: Did your bitch mate with xx's stud dog?
Her: Yes it did
Judge: Have you paid her?
Her: No

you see where I'm going, however if she says no, or decides she heard differently on the agreement, you're royally screwed and you'd most likely lose.

I'd definately be sending her a strongly worded letter though, and cross her off your xmas card list

i really didn't want it to come to this.. i see her almost every day as she works in the local village shop where I live, so didn't want it to get 'nasty' for want of a better word.

She just seems to be under the impression that the remainder of the stud fee should not be paid until she finds out for deffinate if her bitch is pregnant.

I may send her another text telling her I've been in contact with numerous breeders ( ie you guys) and that everyone of you have said that the fee should be paid at the end of the mating.. and NOT when you find out the dog is pregnant/has the pups !

Did you hand over the green form and I have to admit that if I have a dog that I am using for the first time I dont take a stud fee until he is 'proven'
