hi, i hope this is the right place to post this thread, it is the first time i have ever used anything like this before. i am looking for some advice on what i can do. i sold my dogue de bordeaux louie recently to a friend of mine and her boyfriend. i sold him for £500 and it was agreed that they would pay me £50 a month until all the money was paid off and then i would give them his registration papers. however since then they have not paid me any money at all. i have been round to see them and ask for them to return louie to me as they hadnt paid for him, to which they declined. they then told me that they would start paying the money asap and that if they missed a payment i could go round and get louie, they still havent paid anything.
i was wondering if anybody knew were i stood on getting him back, me and my 3 year old daughter miss him dearly and i simply regret my fast decision to sell him in the first place. like i have stated i still have his registration papers and i also have in text message the contract made by myself and my friend about the arrangement of his sale and how the money would be paid and how often. if anybody could give me any advice i would be very grateful as we would like to have him back with us, but i know i can only do this if it is right for me to do so |

Unsure as to where you stand legally - maybe go to CAB? Do you really want the dog back as you believe you can offer the best home or because you haven't received money?
If you are honest with yourself and it is the money that rankles, then maybe cut your losses if the dog is now in a good home. If you honestly believe that you are the very best home for this dog then I am not sure what you can do; wrangling over a dog like it is a piece of property doesn't sit well with me (although I know the law views it that way). I think you need to be very, very honest with yourself and consider what is best for the dog who is unfortunately stuck in the middle of all this. |

I think you'd need to seek some advice on this - maybe Citizens Advice would be a good idea.
You could write a letter before action to your friend, giving him 7 days to return the dog or pay the money in full or you will take him to the small claims court, but I'm not sure if you actually could - do you have a proper written contract, with his signature and a witness? If not, he could try and claim that you gave him the dog. With regards to wanting the dog back, how old is he? Why did you give him away? It seems quite a bizarre situation. |

hi, sorry about posting this in 2 places, i didnt know which one i was ment to post it in. he is 2 and a half years old now. i have had him since he was 8 weeks old until i sold him. the original reason for me selling him was because i was a single mother to my little girl and was also 8 months pregnant, my family were worried about how i would be able to handle 2 young children and him on my own and they managed to talk me into selling him, i have been devestated since and really regret my decision to sell him, my oldest daughter is also upset over this and since him being gone has repeatedly asked me when he is coming home and when we can go and get him back. i am not doing this all for the fact that they have not paid me the money although part of it is on the principle of the matter that if you buy something and agree a payment method then this should be stuck to, as a binding contract has been made between yourself and the seller. i am doing this because i dont believe that they are caring for him in the way that he should be treated. he is kept in the kitchen of there house, which is not suitable for a dog of his size, they also do not take him for walks they simply let him out into their back yard, which is not very big. also he had a few medical problems in which he was having treatment at the vets, i had him their twice a month for check ups on these conditions and for the medication that he needed. i know that they have not been taking him to the vets and can see this as soon as i see him. i honestly thought that these would be suitable people for him to go and live with yet they have proven me wrong

if your friend either refused to pay or return the dog then guess you could go to small claims court, though I don’t really know a lot about it so its probably best to get advice from CAB or someone who knows the system.
