There are a couple of highly dog aggressive Bernese near me. They are generally walked off the lead and will attack on sight. Despite numerous reports the police are unwilling and/or unable to do anything. Mainly on the grounds of them not being one of the four "dangerous" breeds. They may never attack a human, but I could certainly see a child walking a small dog being dragged into the melee when they attack.

I contacted the dog warden's department which mirrored the information I was given by the Police.

I need the owner's details.

They can only speak to him for not having his dogs on lead.

Whilst dog fighting is illegal that only refers to organised dog fighting.

A dog has to attack a person for it to be a criminal offence.

I've decided it isn't worth the hassle.

That's it, to be fair to these dogs were definitely not aggressive to people they were actually weary of me as they circled to find an opening to attack Duke.

I was told by the dog wardens all dogs have to be on a leash even if you are stood at your gate (I assume open gate) talking to someone. Not sure if that's the case for everywhere or just Leeds. Trouble is owners like him are not familiar with the dog laws and ignorance appears to be and acceptable excuse.

I was fired up this morning with the response I got, to attempt a test case it could set a precedent but dog on dog and as they put it not a dangerous breed type it could be throw out of court and I would be well out of pocket.

It is tempting just the same.

My mums reaction was simply because she has never witnessed an aggressive dog fight, only a fracas a few noisy interactions, a snap and retreat.

I know the law states if you feel intimidated or threatened. For me that is too loose, and I would not want to pursue an action on those grounds. That would also start a precedent and wouldn't be good for dog owners in general.

I only have to walk Duke passed people and you can see the panic and fear in them. Any one can say they feel threatened or intimidated by my own dog even though he is on a lead.

I really want the legislation that is already in place enforced. If those dogs had been leashed there wouldn't have been a problem.

A precedent has already been set on the grounds you state so wouldnt have made any difference. Im a little confused about the legislation you want enforced because from what I can see the only law that may possibly have been broken and therefore may possibly be able to be enforced is the DDA1991 or the Dogs Act 1971 (less likely in this case to be successful imho) .

There isnt any law that makes a dog on dog attack illegal at this present time unless a person sets a dog onto another dog(although secondary legislation could be about to go through and god help us all if that happens!)

what law where you thinking of?

What a shame people can't walk thier dogs on a leash but other people who don't bother even having them in a yard get away with it. I just walked the shelties and got attacked by 2 labs so I just let the older sheltie go and got the little one outta the situation. These dogs are always in there yard never loose so was not expecting this at all. Although the owner did come running out he was worried that there might be damage told him he was lucky this time only a stand off. So I took a different route home only to be charged by a large german shepherd which is also normally in it's yard. Teeth were bared so I let go of the leash as Nova would attack if this dog came at me. Gave me a chance to get Nyla and myself outta there and then call Nova at least he has good recall. But my heart is racing, have to walk Neva but the dogs I'm looking after aren't going for a walk think we'll play ball in their yard instead...Jill

All I want is for the guy to be made to keep his dogs on a leash on the public highway, such as you and I would keep our dogs on a leash in the Street especially if our dogs were dog aggressive. I certain wouldn't want my dog killed by a car because he was running after a dog on the other side of the road.

People should have common sense without the need for legislation.
