Exclamation Breeder question/Pug Stenotic Nares

I purchased a pug for quite a bit of money on Feb. 12, a fawn pug named Lola born on Christmas 09. I took her for a wellness checkup on the 16th and my vet told me she has Stenosis of the nostrils Severe (Stenotic Nares) and this will require surgery. The surgery is going to be half the cost of what I paid for the pug. The vet also tells me shes blind in her right eye. Now I love this dog and I WILL NOT give her up or give her back due to this. In the week I've had her now I have grown completely attached. I have contacted the breeder and she doesn't want to acknowledge that I want half my money back to complete the surgery. She just doesn't want to believe that even though I have proof this dog has a birth defect and no vision in the right eye. She is giving me the run-around on paying me half my money back. Has anyone bred pugs on here that may have encountered a problem like this and had to give a refund on your dog? Am I wrong in asking for the cost of the surgery back from what I paid? I don't think I am but she just acts like I paid for the dog now I'm stuck w/her and I have to pay for all this myself. She even said Well give the dog back and I can give you a partial refund!??? This isn't my fault! I would like a breeders point of view on this situation please. You tell me what I should do now, Demand the cost of surgery...Demand a whole refund?? What do I do? Can I sue her for the cost of surgery? She had a warranty on the dog for 3 days and I got the checkup on the 2nd day and let her know on the 2nd day.

As you had the check up within an agreed time, I would have thought most ethical breeders would have either offered to take the pup back or offer something towards the vet's bills. Did you sign a contract? Are they a member of a breed club?

Try contacting trading standards. You have legal rights under The Sale Of Goods Act.

She is an AKC breeder, I am in the USA I didn't realized these forums are UK so I don't know if anything is different most likely standards are different here. I did take video last night of her breathing due to the stenotic nare and its heartbreaking its so bad. I did not sign a contract we emailed so I have a log of everything said between us including the warranty. I emailed her last night demanding some form of payment so I'm sitting here fingers crossed hoping she just falls in line and realizes this is going to get a lot worse because I'm not letting her slide, I just have to put my foot down and its so hard because I'm such a nice person but the health of this beautiful puppy is more important to me at this time. Thanks for the support.

What terrible behaviour from the breeder, any decent breeder would be concerned about the pup and want to investigate the health issues personally.

I would contact a solicitor for advice as if you have no Insurance yet you won't get any now for these conditions and this problem will be ongoing and could cost alot of money

What an awful position to be in.

I would also contact the AKC I'm in Canada and we have the CKC, they are usually pretty good. The breeder has to take care of this the AKC may advise her of that, they may even stop her from registering other pups if she doesn't. They may also advise you that all she needs to do is offer you a different pup and she'll take that one back. If she offers that then you have to make a decision. Also I'm not sure what you call the standards branch there but unfortunately dogs and cats are a commodity much like a car so do some checking maybe ask the better business bureau or your local government rep. Please let us know if she comes through. She shouldn't breed those dogs anymore either as it is hereditary ....Jill
