I am sure this is at least 99 percent not true. There is no law says that dogs have to be tested. The only time I can imagine it could be true is if someone who is breeding as a business claims that the puppies will be free of whatever the hereditary disease is.

Pet litters would have no come back at all and the majority of 'breeders litters' would not either as they are not counted as a business.

If the breeders puts it down into writing that no testing have been done, for X and Y reason then I am not sure how it would stand in court, the breeder may have a chance.
- But if testing hasnt been talked about, or health tests were lied about and a dog suffers for a test that should/could have been tested for the owner is likely to win the court case - I've seen it, and fair play to the owners. Breeders need to learn!
