Does he move around the pen? If he is very nervous, he may be to frightened to move and go for a wee, preferring to stay where he is. Cats won't poo either if they don't feel its safe where they are and new kittens very often hang on for a couple of days before they go. You could try putting a blanket over the end of the pen where the tray is, to make it more private and secure feeling for him.

Ok thanks again i will try moving the tray to the back of the cage next to their bed and cover that side of the cage with a big blanket.
I have their bed at the back so they can hide if they want but still see what is going on and get used to their suroundings. Then i have the tray at the front away from the bed thinking they would not like to sleep right next to the their toilet.
I can see this beeing quite funny if any 1 is waqtching me do this, i am not a small girl. I will be trying to squeeze in to the back of the cage now and help then to go on the tray and sho wthem how to cover up with the litter and what to do.
